Do we need a registered trademark?
Not to trade, but registration is what lets you stop someone else using your name. Unregistered rights exist in Canada through use, but enforcing them is slower, more expensive and less certain than pointing at a registration.
What do you actually do here?
Preliminary screening against the Canadian trademarks database, guidance on classes and how the name is used, and preparing what a trademark agent needs. We are not a law firm and we do not file. Where you need legal advice, we will say so and point you at an agent.
When should we file?
Before investing in signage, vehicles and print, not after. The expensive scenario is discovering a conflict once the name is on twelve vehicles. Screening early costs very little relative to that.
How long does registration take?
Canadian trademark registration is measured in years rather than months, and has been slower in recent years. Filing early matters, because the application date is what establishes priority even while the process runs.
